Guidelines for Law Enforcement Requests & Subpoenas

Our Policy

Requests for private information relating to an Earnin Community Member (“Member”) or an Earnin Employee (“Employee”) requires law enforcement to obtain a subpoena, court order, or other valid legal process. The requesting agency seeking a subpoena or court order must compensate Earnin for subpoena response services according to the terms outlined in this policy and must provide all required information to process the request.

Upon receipt of a valid subpoena, Earnin will promptly notify the individual whose information is sought unless directed otherwise by government regulations. In non-emergency circumstances, Earnin will not produce the subpoenaed identity information until approximately four weeks after receipt of the subpoena, so that the individual whose information is sought will have adequate opportunity to move to quash the subpoena in court.
