Guidelines for Law Enforcement Requests & Subpoenas

Our Policy

Requests for private information relating to an EarnIn Community Member (“Member”) or an EarnIn Employee (“Employee”) requires law enforcement to obtain a subpoena, court order, or other valid legal process. The requesting agency seeking a subpoena or court order must compensate EarnIn for subpoena response services according to the terms outlined in this policy and must provide all required information to process the request. 

Upon receipt of a valid subpoena, EarnIn will promptly notify the individual whose information is sought unless directed otherwise by government regulations. In non-emergency circumstances, EarnIn will not produce the subpoenaed identity information until approximately four weeks after receipt of the subpoena, so that the individual whose information is sought will have adequate opportunity to move to quash the subpoena in court.

Request Requirements

We only respond to requests that contain the required items below. Requests received that are incomplete will go unanswered. The following information must be included for every request:

Member Requests

  • Requesting agency name
  • Requesting agent contact information including:  email address, phone number, and mailing address
  • Member name used to sign up in addition to a secondary identifier such as: email address and/or phone number*
  • Details about what specific information is requested and its relationship to the investigation. EarnIn is unable to process broad or vague requests

*Please note that we can only look up Members using the name provided upon account registration. 

Employee Requests

  • Requesting agency name
  • Requesting agent contact information including:  email address, phone number, and mailing address
  • First and last name of the Employee using a legal first name e.g., Jonathan instead of John.   
  • Social security number
  • Address
  • Details about what specific information is requested and its relationship to the investigation. EarnIn is unable to process broad or vague requests

Emergency Requests

  • Requesting agency name
  • Requesting agent contact information including:  email address, phone number, and mailing address
  • Individual Identifier:
    • If Member: Name used to sign up in addition to a secondary identifier such as: email address and/or phone number*
    • If Employee: First and last name using a legal first name e.g., Jonathan instead of John; SSN; Mailing Address. 
  • Detailed description of the nature of the emergency (e.g. potential bodily harm, crime being committed)
  • Details about what specific information is requested and its relationship to the investigation. EarnIn is unable to process broad or vague requests

Release of Information

Member Information

To utilize EarnIn services, Members may provide certain personal information as outlined in our Privacy Policy. Each service offered by EarnIn collects different information from its Members. It is possible that not every single item shown in the list below has been disclosed by Members. 

EarnIn will not release social security numbers/government identification numbers, copies of bank statements, or health information. EarnIn does not release third party information. Geolocation information will only be provided in an emergency situation such as preventing physical harm or reporting suspected illegal activity. 

All requests for information will be carefully reviewed and information will be provided on a case by case basis. Depending on the nature of request (law enforcement, civil order, etc.) and usage of EarnIn services,  we may be able to respond with the following information: 

  • Email address
  • Phone number
  • Date of account creation
  • In-app actions covering the last two weeks prior to receiving the request including transfer information
  • Customer Support messages

Secure email will be used to deliver the requested information and may be in CSV, PDF, XML, DOC, or ZIP file formats. 

Employee Information

As part of the application or new hire process, employees may provide certain personal information as part of their personnel files, payroll records, or benefit elections. EarnIn will not release Social Security Numbers, government identification numbers or account/routing numbers. 

All requests for information will be carefully reviewed and information will be provided on a case by case basis. Depending on the nature of request (law enforcement, civil order, etc.), we may be able to respond with the following information:

  • Application Information
  • Contact Information
  • Payroll Information
  • Date of hire
  • Date of resignation or termination and reason for resignation or termination. 

Secure email will be used to deliver the requested information and may be in CSV, PDF, XML, DOC, or ZIP file formats. 

Cost Reimbursement

Earnin will charge the entity submitting the civil subpoena for costs associated with subpoena compliance as permitted by law under 18 U.S.C. §2706. Earnin’s subpoena response cost is billed at $125.00 per research hour. Payment must be made within thirty (30) days from the date of receipt of the Earnin invoice. Checks should be payable to Earnin.
